Digital Vector Maps Standard License Agreement
This Agreement is made between Digital Vector Maps and the Purchaser of Digital Vector Maps map image(s).
Grant of Rights
This license grants you the non-exclusive right to use Digital Vector Maps images and any derivatives or copies on one computer with one user at a time. You are granted:
1. Access to Digital Vector Maps map files by a workgroup consisting of individuals working in collaboration on a project for which the map files(s) were purchased.
2. Use of map images in resale products such as books (print and eBook), magazines, games, book & magazine covers, CD labels and product boxes, brochures, pamphlets, posters, displays, video or film productions and broadcasts and many other products which may require the use of a high-quality digital map
Usage
This license grants you the right to use, modify and include the Digital Vector Maps map images as part of a total graphic design for you, yourclient or your employer. You may make a single copy of the softwareto give to a service bureau for output or to your client for their library.The client or service bureau is not granted any usage rights other thanreproducing the original work. You may not sell, lease, loan, transfer,or distribute any copy of the map images, except as stated above.
Proprietary Rights
Digital Vector Maps map images, in whole or in part, are owned by Digital vector Maps, and are protected by all copyright laws with all rights reserved. All intellectual and proprietary rights therein are and remain the property of Digital Vector Maps.
Term
This agreement is effective unless terminated. This Agreement willterminate if Purchaser fails to comply with any term or condition of this agreement. Upon termination, you agree to destroy all copies of the Digital Vector Maps Map Images.
Limitations on Warranties and Liability
All implied warranties on this media, software, and manual, includingimplied warranties of merchantability and fitness for a particularpurpose, are limited to thirty (30) days from the date of the originalretail purchase of this product. Neither Digital Vector Maps nor any of its suppliers make any warranty or representation, either express or implied, with respect to the software described in this manual, its quality, performance, merchantability, or fitness for any particular purpose. The map file is sold "as is." The purchaser assumes the entire risk as to its quality and performance. In no event will Digital Vector Maps, or its suppliers be liable for direct, indirect, special, consequential, or incidental damages resulting from any defect in the map images, even if they have been advised of the possibility of such damages. In particular, they shall have no liability for any programs or data used with Digital Vector Maps products, including the cost of recovering or reproducing these programs or data.
The warranty and remedies set forth above are exclusive and in lieu ofall others, oral or written, express or implied. No Digital Vector Mapsemployee, dealer, or agent is authorized to make any modification,extension, or addition to this warranty. Some states do not allow theexclusion of implied warranties or liability for incidental orconsequential damages, so the above limitation or exclusion may notapply to you. This warranty gives you specific legal rights, and youmay have other rights that vary from state to state.
Miscellaneous
This AGREEMENT is the entire agreement between Digital Vector Maps and the Purchaser concerning the map images. This AGREEMENT may not and cannot be assigned or transferred to a Use other than that stated above. This AGREEMENT can only be modified by a properly signed written agreement. This License shall be governed by and construed under the laws of California. The prevailing party in any legal action to enforce this AGREEMENT shall be entitled to reasonable attorney's fees and costs.
